PRINTGIANT.COM IS OWNED AND OPERATED BY PRINTGIANT, LLC BY VISITING, USING AND/OR REGISTERING WITH THE PRINTGIANT.COM WEBSITE ("SITE"), YOU (REFERRED TO HEREAFTER AS "YOU", "YOUR”, "USER”, “CLIENT”, OR “CUSTOMER”) AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS (THE "TERMS & CONDITIONS"). THE TERMS & CONDITIONS CONSTITUTE A LEGALLY BINDING AGREEMENT BETWEEN YOU AND PRINTGIANT, LLC (HEREAFTER ALSO REFERRED TO AS “PRINTGIANT”, ”WE", "US", OR "OUR") AND GOVERN ANY AND ALL USE OF THE SITE BY ANY AND ALL USERS OF THE SITE AND ANY SERVICES OFFERED THEREFROM. IF YOU DO NOT AGREE WITH ANY CHANGE, MODIFICATION OR AMENDMENT PRINTGIANT MAY MAKE TO THE SITE TERMS YOU MAY WITHDRAW YOUR CONSENT TO BE BOUND TO THE CHANGES BY NOTIFYING PRINTGIANT IN WRITING IMMEDIATELY. IF YOU WITHDRAW YOUR CONSENT, HOWEVER, YOU MUST IMMEDIATELY DISCONTINUE YOUR USE OF YOUR ACCOUNT AND THIS SITE. YOUR ACCOUNT WILL BE DEACTIVATED AND YOU AND WILL NO LONGER BE ELIGIBLE TO USE THIS SITE OR ORDER FURTHER PRODUCTS OR SERVICES FROM THIS SITE. IF YOUR ACCOUNT IS DEACTIVATED, THIS WILL NOT AFFECT YOUR RESPONSIBILITY FOR PAYMENT OF JOBS ALREADY COMPETED AND/OR IN PRODUCTION.

The Site Terms apply exclusively to your access and/or use of this Site and do not alter in any way the terms or conditions of any other written agreement you may have with PrintGiant.

Communication

Your use of this Site constitutes your agreement and consent that PrintGiant may communicate with you electronically for all purposes. This includes all legal and notice requirements. Such electronic communication may take the form of postings to this Site and/or emails forwarded to the email address you provide when you created an account with PrintGiant.com.

You may withdraw your consent to receive electronic communication at any time, but if you withdraw your consent it will only be effective for future projects and will not affect projects already in progress. Be advised that by withdrawing consent to receive electronic communication you will no longer be eligible to use the Site to order products or services from PrintGiant.com and your account on the Site will be deactivated. If your account is deactivated, you will remain responsible for payment of projects already completed or in progress.

Site Use Restritions

You are being provided with a limited license to use this Site solely for the purpose of assessing the product and service offerings on the Site, and placing orders for the products and services offered by PrintGiant via this Site. You may not use robots or other automated means to access this Site, unless expressly permitted by PrintGiant.

It is a violation of law to use this Site in a false name or with an invalid credit card. Fraudulent users may be prosecuted to the fullest extent of the law.

Unless you received PrintGiant's express written consent, you may not:

  • collect information about the Site or users of the Site.
  • resell or make any other commercial use of this Site or the Site content.
  • use any deep-link, page-scrape, robot, crawl, index, spider, click spam, macro programs, internet agent, or other automatic device, program, algorithm, or methodology which does the same things, to use, access, copy, acquire information, generate impressions or clicks, input information, store information, search, generate searches, or monitor the Site or any portions thereof;
  • modify, adapt, translate, reverse engineer, decompile, disassemble, or convert into a readable format, any part of this Site or it’s underlying code, except as it may be interpreted and displayed by your web browser for the purpose of using this Site.
  • access or use the Site for competitive purposes.
  • disguise the origin of information transmitted to, from, or through the Site.
  • copy, imitate, mirror, reproduce, distribute, publish, download, display, perform, post of transit any Site content in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise;
  • impersonate another person.
  • distribute viruses or other harmful computer code.
  • allow any other person or entity to impersonate you to access or use theSite;
  • make a derivative use of the Site and/or any Site content.
  • use the Site for any purpose in violation of local, state, national, international laws.
  • use the Site in a way that is intended to harm, or a reasonable person would understand would likely result in harm, to the user or others.
  • circumvent any measures implemented by us aimed at preventing violations of the Terms & Conditions

We expressly reserve the right, in our sole discretion, to terminate a user’s access to any or all areas of the Site due to any act that would constitute a violation of these Terms & Conditions.

Site Registration

It is necessary for you to register and establish a membership account in order to take advantage of the full functionality of this Site and to order products and services. In the event that updated, new, and/or enhanced features are added to this Site, previously registered users will not be required to re-register. However you may be required to re-acknowledge these Terms and Conditions and/or other Site Terms that may accompany these new features, updates, and/or enhancements.

You are responsible for all activities that occur under your registered account. If you believe your account has been compromised in any way you should immediately change your account password by logging into your account and following the instructions for changing your password. You must also immediately notify PrintGiant in the event you become aware of any unauthorized use of your account.

You agree to provide accurate and current information about yourself (and your company) as requested during the registration process. You also agree that it is your responsibility to update and maintain your account information to be current and accurate.

Not all products and services on this Site are available to all customers. You agree that when you access this Site, you are entitled to order those products and services available to you.

This Site and its products and services are intended solely for persons who are 18 years of age or older. Any access or to use the Site by anyone under 18 years of age is prohibited. By accessing or using the Site, you represent and warrant that you are 18 years old or older.

User Content and Responsibility

You may elect to electronically upload or otherwise submit data, text, photographs, graphics, messages, or other materials (Referred to hereafter collectively as “Customer Content”) to PrintGiant for inclusion when ordering certain products or services that require customization. You understand and agree that you are solely responsible for all Customer Content. When you upload, or otherwise transmit Customer Content to PrintGiant you warrant and agree that you either own the copyright or have secured permission to use any documents, text, graphics, photographs, etc., that you submit for inclusion in your customized product, and you agree to defend, indemnify, and hold PrintGiant and its officers, directors, employees, shareholders, agents, partners, and affiliates, harmless from any suit, demand, or claim arising our of any breach of this warranty and agree to pay any judgement or reasonable settlement offer resulting from any such suit , demand, or claim, and to pay any attorney’s fees incurred by PrintGiant in defending against such suit, demand or claim.

You are solely responsible for the content and context of any material you post or submit through the Site. You agree that you will not send, upload, post, or otherwise transmit to PrintGiant any content that: (i) are unlawful, threatening, harassing or profane; (ii) restrict or inhibit any other user from using or enjoying the Site; (iii) constitute or encourage conduct that would constitute a criminal offense or give rise to civil liability; or (iv) contain a virus or other harmful component or false or misleading indications or origin or statements of fact.

PrintGiant is not responsible for maintaining Customer Content indefinitely. Customer Content uploaded to the Site or created using our online tools will be kept available in the Account section for a period of (15) fifteen days. At the end of that fifteen day period it may be deleted and irretrievable. Customer Content that is not deleted at the end of the fifteen day period will remain active for any amount of time, until PrintGiant under its sole discretion, may deem it necessary to delete. It is your responsibility to store Customer Content you want to keep indefinitely on your own computer hard drive or server.

You agree that PrintGiant is not obligated to pre-screen Customer Content, but that PrintGiant does reserve the right to do so at any time and that PrintGiant and its affiliates and partners shall have the right, but not the obligation, in their sole discretion to remove Customer Content and/or to refuse to fulfill a request or order that violates these Site Terms or that may otherwise be objectionable. You further acknowledge that PrintGiant may disclose Customer Content if required to do so by law.

Site Linking

It is prohibited to create or maintain any link from another website to any page on this Site without our prior written consent. You may not run or display this Site or any material or content displayed not his Site in frames or through similar means on another website without our prior written permission.

Design Tools

The design tools available on this Site are made available to all users of the Site. With any design you may create using the design tools available on this Site, you do not obtain any right or claim to any of the individual design elements made available through this Site that enabled you to create your design. These design elements are and will continue to be the property of PrintGiant, or the licensors if applicable, and will remain freely available to other PrintGiant customers. Your use of the Site Content provided on this Site and/or the creation of products or materials using such Site Content does not create joint authorship, joint ownership, works made for hire, or any other interest of any kind, with PrintGiant in or regarding such Site Content.

It is solely your responsibility to determine whether any design you may create using the design tools available on this Site, infringes, or may be subject to a claim of infringement upon the trademark, copyright, or other rights of a third party.

Online design tools may not be available for all products.

Submitted Artwork

You are 100% responsible for the accuracy of your print-ready artwork files, and we encourage you to proofread all files carefully before submitting or transmitting to PrintGiant.com. PrintGiant is not responsible for any issues as to orientation or alignment of the pages of your submitted artwork.

PrintGiant does not make any changes on customer submitted artwork. Once you submit an order and provide your own artwork, you are agreeing that you are fully satisfied with the document layout and content and you accept responsibility for any error therein.

Proofs

PrintGiant provides instant online proofs, and in certain circumstances graphic designer generated proofs, or physical proofs.

Instant Online Proofs are generated by our system for artwork that is created using our online design tools, or when print-ready files are uploaded by the user. Completing the order process constitutes approval of the instant online proof.

When the option to select a Graphic Designer proofs is available, it will be accessible on the product page pricing calculator. Graphic designer proofs are generated by a PrintGiant graphic designer and are submitted as digital files for your review. The request for a graphic designer proof may involve an additional fee and would extend the amount of time needed to complete the project. Actual time will vary depending on our current workload. Projects with graphic designer proof requests will not be sent to production without your approval.

When the option to select a physical proof is available, it will be accessible on the product page pricing calculator. Physical proofs are meant to show reasonable likeness to the final printed pieces. Physical proofs are printed on a substrate different from the actual paper stock with a method that may be different from the final product, and while its main purpose is to show color, variations may occur depending on the finish selected or other variable. The request for a physical proof may involve an additional fee and would extend the amount of time needed to complete the project. Projects with physical proof requests will not be sent to production without your approval.

PrintGiant has and assumes no obligation to proof or otherwise review the content or layout of your order. Even if a PrintGiant representative has inquired as to the attributes of one of your prior orders, you are not entitled, nor should you assume that PrintGiant will review any other order you place.

Once you proofs are approved and you submit an order to production, you are agreeing that you are fully satisfied with the document layout and content and you accept responsibility for any error there. PrintGiant will assume that you have verified the spelling, grammar, content, and layout, etc. are all correct and wit will not accept any liability for errors such as misspelling, graphics, grammar, damaged fonts, punctuation, transparency, overprint, improper layout, bleeding, erroneous cut or fold lines, die lines, crop marks, sizing, etc.

When you purchase Graphic Design services from PrintGiant, the proof is governed by the terms specified in the Graphic Design Terms.

No Liability for Errors

PrintGiant is not liable for error in a final product caused by any of the following reasons:

  • Spelling, punctuation and grammatical errors
  • Low resolution or low quality graphics and images
  • Damaged fonts
  • Transparency issues
  • Overprint issues
  • Artwork files that are not created following our specifications
  • Variances in color from the conversion of Pantone or RGB colors to CMYK
  • Errors in the user-selected options such as size, quantity, paper, finish, etc.
  • Duplicate order submitted by the User
  • Incorrect files uploaded
  • Incorrect file orientation
  • Cracking on folds
  • Cutting variances
  • Incorrect or undeliverable shipping address
  • Damage to products after delivery to User

You are responsible for reviewing your files and correcting any information or issues prior to placing an order.

Color

PrintGiant will produce full-color projects that will meet CMYK industry standards. Because of the inherent limitations of gang run printing, the accuracy of color reproduction is not guaranteed. By placing an order with PrintGiant.com you agree to this limitation. Under no circumstances will a reprint be honored for color variations that have occurred during the printing process. PrintGiant is not responsible for any color shift in converted artwork from RGB to CMYK, or Pantone to CMYK. Please note that the application of a coating may have an effect upon or change the appearance of a printed color.

Payment

All prices and amounts shown on this Site are in U.S. Dollars, unless otherwise noted. All price are subject to change whiteout notice and payment amounts and other terms may be subject to additional agreements between User and PrintGiant.

PrintGiant currently accepts payments via the following credit cards: Visa, MasterCard, American Express, Discover; or via PayPal. We reserve the right to stop accepting any payment method from any issuers.

When you submit an order on the Site to purchase any product, mailing services, design services, or other services, you agree that all charges, taxes, and shipping/handling fees will automatically be charged to the payment method active in your account.

Sales Tax

PrintGiant collects sales tax on orders shipped to an address within the state of Colorado, unless you are tax exempt. If you are tax exempt, you must mail, fax, or email your tax exemption certificate.

If after payment for a project is received, if it is determined that more tax is due, then the User must promptly remit the required taxes to the taxing authority or immediately reimburse the provider for any additional taxes paid.

Production Time

Production time begins after we have received print-ready files, approval for proof - if applicable, and full payment for the order. Production time does not include shipping time. Once an order is placed, production time generally cannot be changed and billing charges will to be reversed.

Production time and production time options will vary by the products. Not all products have the same production times or production time options. Production time and any available production time options will be listed in the pricing calculator for each product.

Production time is based on business days (Monday - Friday) and does not include weekends and observed federal holidays.

Unless otherwise noted, the cutoff times for the various options are:

  • Standard Production - orders must be paid, print-ready files received, and proofs must be approved by 11:00 AM EST (9:00 AM PST) will be processed and sent to production the same day. Any order that is paid, has print-ready files sent, or has proofs approved after 11:00 AM EST (9:00 AM PST) will be processed and sent to production the following business day.
  • Rush Production - orders must be paid, print-ready files received, and proofs must be approved by 8:00 AM EST (5:00 AM PST) will be processed and sent to production the same day. Any order that is paid, has print-ready files sent, or has proofs approved after 8:00 AM EST (5:00 AM PST) will be processed and sent to production the following business day.

Please note: production time is when the product will be finished production, and not when a product will ship. If a product finishes production after that day’s shipment has been picked up, the product will be shipped the next available business day.

Production Over/Under Runs

Although it is our goal to ship the actual quantity ordered, we reserve the right to ship within a 5% over or under the requested quantity. Some specialty products may have a higher over/under run percentage. In such cases the over/under percentage will be noted on the product page.

Promotions

From time to time PrintGiant may offer special offers, promotions, or discounts identified by a Coupon Code. Each Coupon Code will have different requirements and rewards. When encountering a Coupon Code promotion, it is important to read it carefully, as the requirements stated in the offer must be met in order to receive or take advantage of the promotion or offer. Unless otherwise stated, Coupon Codes are limited to one-time use and are limited to account holders in good standing.

To take advantage of a Coupon Code promotion, you will need to enter the Coupon Code in the applicable field when placing an order. Not all products are eligible for promotions and special offers. If a Coupon Code does not functions when entered, it means the product at issue does not qualify for the promotion or special offer; this determination is final.

Coupon Codes may not be combined with any other promotions, special offer, discount, or reward offered by PrintGiant.

Coupon Codes only apply to products ordered through this Site. Coupon Codes may not be used for orders placed by phone, email, or any other direct contact method. Coupon Codes cannot be applied to special or custom orders.

Coupon Codes cannot be used to pay for taxes, shipping and handling, or other charges. If the promotion or special offer has a minimum purchase requirement, taxes, shipping and handling and other charges do not apply towards the minimum purchase amount.

Promotions and special offers are only valid for a limited time. They will expire on the date or within the timeframe specified in the offer. If no date or timeframe is specified, a promotion or special offer will expire at the end of the month is which the Coupon Code is first eligible for use.

Coupon Codes (and the Coupons or emails that contain them) are not for resale, have no independent cash value, are not redeemable for cash, and will not be replaced if lost, stolen or deleted.

Coupon Codes cannot and will not be retroactively applied against any orders already place, either active or completed.

PrintGiant reserves the right to discontinue a promotion or special offer or coupon at any time and with immediate effect.

Order Cancellations

An order can be canceled at any time prior to it entering into production. If you cancel an order prior to it entering into production someone from PrintGiant will contact you to will inform you of any cancellation charges incurred. Please allow at least 10 business days for refunds to be credited to your account. A print order cannot be canceled and no refund will be given once it has entered into production or any process thereafter. All cancellations must be completed through this Site by accessing your Pending Orders. If you do not see a button for cancellation, the job has gone into production and cannot be canceled.

Logo and Graphic design services refunds are subject to the terms outlines in the Graphic Design Terms.

If within thirty (30) days of you placing an order, we have not received any necessary files or proof approval that will allows us to process and complete your project, PrintGiant may at its option cancel theorizer and refund any payment charged to your payment method.

Copyright Ownership

You acknowledge that all content included on this Site, including, without limitation, the information, data, software, photographs, typefaces, graphics, images, illustrations, maps, designs, icons, written and other material and compilations (collectively, “Content”) are intellectual property and copyrighted property of PrintGiant, LLC., its licensees, and/or various third-party providers (“Providers”). Except where expressly provided otherwise by us, nothing made available for your use via the Site does not convey to you or any other person an interest of any kind to the Site Content. PrintGiant reserves the right to add, delete, or modify any part of the Site Content at any time without prior notice. All rights not granted to you in the Terms & Conditions are expressly reserved by us.

Trademarks

PrintGiant.com and any and all other marks appearing on this Site are either trademarks or registered trademarks of PrintGiant in the United States and other Jurisdictions (“Trademarks”). You may not use, copy, reproduce, republish, upload, post, transmit distribute or modify the Trademarks in any way, including in advertising or publicity pertaining to distribution of materials on this Site, without PrintGiant’s prior written consent. The use of Trademarks on any other website or network computer environment is prohibited. PrintGiant.com prohibits the use of Trademarks as a "hot" link on, or to, any other website unless establishment of such a link is pre-approved by PrintGiant in writing.

Copyright Policy

The Digital Millennium Copyright Act (“DMCA”) provides information for copyright owners that believe material on the internet infringes their rights under U.S. Copyright law. Is is our policy to respond to appropriate notices of alleged copyright infringement that comply with DMCA. If you believe in good faith that material on this Site infringes on your copyright, you may send us a notice requesting that the material be removed.

Your notice must provide the following:

  • Information so we can identify and contact the claimant. Name, address, phone number, and if available an email address.
  • Detailed information for the copyrighted work that you believe is being infringed. Links, screen grabs, or images are suggested.
  • Identify in detail the material you are claiming is infringing that you wish to have removed.
  • provide a statement that you have a good faith belief that material being used is not authorized by the copyright owner. Governing Law

You agree that you shall indemnify and defend and hold PrintGiant and its officers, directors, employees, shareholders, agents, affiliates, subsidiaries, suppliers and representatives, harmless from and against any and all claims, damages, losses, costs, and expenses, including attorneys' fees that, directly or indirectly, arise out of or are related to: (i) your use of the Site, (ii) your breach of the Terms & Conditions, (iii) your dispute with another user, (iv) the unauthorized access to any password-protected area of the Site using your password, and (v) any image or content being reproduced as part of your order.

Third Parties

If you use this Site to submit Requests for or on behalf of a third party (“Third Party”), you are responsible for any error in the accuracy of information provided in connection with such use as well as for any Request submitted, including related fees, charges, and performance obligations.

Feedback, Comments, and Other Submissions

All feedback, comments, ideas, and other suggestions disclosed, submitted, or offered to a Covered Party in connection with your use of this Site (collectively, “Comments”), shall become and remain the exclusive property of PrintGiant, LLC.. The Comments may be used by a Covered party in any medium and for any purpose worldwide, without obtaining your specific consent and you relinquish all rights to such Comments. No Covered party is under any obligation to maintain your Comments (and the use of your first name and first initial of your last name with any Comments) in confidence, to pay to you any compensation for any Comments submitted or to respond to any of your Comments. You agree you will be solely responsible of rate content of any Comments you make.

Termination

PrintGiant reserves the right to suspend or terminate your account and access to the Site and its services at any time for any reason or no reason at all, and to block or prevent future access to and use of this Site by you.In the event your right to use this website is terminated, these Site Terms shall still apply.

If you become dissatisfied with the Site, your sole and exclusive remedy is to immediately discontinue use of the Site.

Changes to Site Terms

PrintGiant reserves the right to modify, change and/or amend these Site Terms at any time. The right to modify, change, and/or ament the Site Terms is exclusive to and within the sole and exclusive discretion of PrintGiant.

If the Site Terms are changed, modified, and/or amended, we will post the new terms on this Site with the date of the update. The new Site Terms will be affective as soon as they are posted on the Site. PrintGiant has security measures in place to protect customer information. Credit Card and sensitive information you provide is protected through the use of Secure Socket Layer (SSL) encryption technology. SSL technology represents a high level of security available on the Internet, automatically encrypting information traveling over the Internet, verifying the identity of the transacting servers through certificates and digital signatures, and confirming that the integrity of the message content is maintained throughout its transmission. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we employ commercially reasonable security measures to protect data, we cannot guarantee the security of any information transmitted to the Site and are not responsible for the actions of any third parties that may receive any such information.

Please note that information provided to us in file uploads for print fulfillment is not regarded as sensitive information requiring encryption.

Account information and other password protected areas of the Site can be accessed only with a valid user name and password. The password you choose is only as effective as you make it. Each password owner is responsible in choosing an appropriate password and for keeping the password confidential and safe, as we have no control or responsibility for this type of user information. You should not share your password information with anyone, and you should always log out of the Site before leaving your computer to protect against unauthorized access of your information. Shipping Policy

Shipping Carriers & Methods

We expressly reserve the right, in our sole discretion, to use the shipping service of our choice, including but not limited to UPS, FedEx, DHL, or others. Our default shipping method is Ground, but you may elect to use alternate shipping methods available in the pricing calculator during the ordering process. Saturday shipping may be available in certain circumstances for an additional charge. Please contact us directly for more information regarding Saturday Delivery. All orders are shipped F.O.B. Shipping Point, which means ownership and risk of loss transfers to you once we deliver the products to our shipping carrier.

Client Account

Unfortunately, we are not able to ship using a client supplied account number for UPS or any other carrier.

Shipping Time

Shipping Time will vary according to the method of shipping chosen and/or your location. Our products ship directly from production facilities distributed throughout the United States, Canada, and China. Therefore when you place an order, we generally produce your items at the closest facility to your chosen delivery address. However, there are some products that can only be produced in specific facilities, which may be further away from your delivery address requiring longer shipping times. Ground shipments usually average one (1) to two (2) business days for most common full-color projects that can be produced in a facility near your delivery address, but can take as long as five (4) to seven (5) business days if produced in a facility further away from your delivery address. Therefore if your project is time sensitive, we urge you to select a method that has carrier guaranteed shipping transit times, like 3 Day, 2 Day, or Overnight to ensure a specific shipping time. It is important to remember that shipping time is in addition to the project production time that you select in the pricing calculator while placing your order.

We reserve the right to change the facility initially allocated to produce your order.

Group Shipping

Each product ordered is processed, tracked, and shipped individually. Each product ordered will require a separate shipping charge and it will have it’s own shipping time and tracking number. We are not able to accommodate requests to ship multiple products as a group.

Split Shipping

We are not able to split a quantity of an order to ship to different lo different locations. A print run quantity is processed, tracked, and shipped as a single product.

P.O. Boxes

We do not ship to Post Office boxes (P.O. Box). it is your responsibility to provide a street address, and to verify that it is correct and accurate.

Non Delivery

If you decide to refuse a shipment (which would include a failure to pick up the product from the carrier, if applicable) or if you made an error, e.g. not submitting the correct shipping address, which may cause a packaged to be reshipped (with the correct address if applicable), you will be charged and addition shipping fee to reship the items. You may also incur additional fees as a result of the inability of the carrier to deliver the order, as well as return fees. Even if you decline to have a product reshipped, you will continue to be responsible for the product cost, original shipping, and any additional fees incurred as a result of the product being returned, and you consent o these fees being charged against your method of payment on file.

Shipping Address Changes

If, after placing an order, you wish to change the shipping address you may do so up until the time the order is shipped. Each time that you request that we intercept and transport an order to a new shipping address you will incur an administration fee of at least fifteen dollars ($15) as well as any increases in the shipping fees and other charges the carrier may impose. You consent to these fees and charges being charged against the payment method on file.

Residential Shipping

It is important to note that if you choose a residential address as your delivery address, the carrier will typically not require a signature at the time of delivery and the package may be left at the address. If you want to ship to a residential address and require a signature for delivery, please contact us.

Disclaimer

We will make every effort to adhere to our production and shipping estimated times. However, equipment failures, technical problems, shipping delays and other problems beyond our control may delay the printing and delivery process. Under such circumstances rush charges and other production fees may be waived or refunded as applicable, however, such delays are not grounds for cancellation of an order. By placing an order with 4over you are agreeing that we are not responsible or liable for, and no refund, cancellation or credit will be due as a result of shipping company delays, acts of God, weather conditions, environmental or dangerous goods incidents, perils of the air, public enemies, public authorities acting with actual or apparent authority, acts or omissions of customs officials, authority of law, quarantine, riots, strikes, work stoppages or slowdowns, or other labor disputes or disturbances, civil commotions or hazards incident to a state of war, local or national disruptions in ground or air transportation networks or systems due to events beyond our control, disruption or failure of communication and information systems, disruption or failure of utilities, international customs issues, any other circumstances that are beyond our direct control.

Graphic Design Terms

By using the PrintGiant.com website (“Site”) and purchasing print graphic design, digital graphic design, logo design, illustrations, and other design services (collectively, “Graphic Design”) on or through the Site, you (referred to hereafter as “you”, “your”, “user”, “client”, or “customer”) acknowledge that you have read, understood, and agree to be bound by this Graphic Design Policy.

We reserve the right to amend and update this Graphic Design Policy without prior notice to reflect changes in our policies, and/or services. When changes are made to this Graphic Design Policy we will revise the “Last Updated” date at the top of this Graphic Design Policy page. Please make sure that you visit and review this Graphic Design Policy page frequently as each time you place an order with PrintGiant, the current Graphic Design Policy will apply.

If you do not agree with the Graphic Design Policy, your sole and exclusive remedy is to not use the Site.

Payment

You agree to pay the fees in full prior to any obligation of PrintGiant to perform under this Agreement. You further agree that when you submit an order on the Site to purchase any graphic design services, you agree that all charges, taxes, and fees will automatically be charged to the payment method active in your account.

Provided Assets

In order to provide you with Graphic Design service, we may request that you electronically upload or otherwise submit data, text, photographs, graphics, messages, or other materials (Referred to hereafter collectively as “Customer Content”) to PrintGiant for inclusion when ordering graphic design services. You understand and agree that you are solely responsible for all Customer Content. When you upload, or otherwise transmit Customer Content to PrintGiant you warrant and agree that you either own the copyright or have secured permission to use any documents, text, graphics, photographs, etc., that you submit for inclusion in your customized Graphic Design project, and you agree to defend, indemnify, and hold PrintGiant and its officers, directors, employees, shareholders, agents, partners, and affiliates, harmless from any suit, demand, or claim arising out of any breach of this warranty and agree to pay any judgement or reasonable settlement offer resulting from any such suit , demand, or claim, and to pay any attorney’s fees incurred by PrintGiant in defending against such suit, demand or claim.

You are solely responsible for the content and context of any material you post or submit through the Site. You agree that you will not send, upload, post, or otherwise transmit to PrintGiant any content that: (i) are unlawful, threatening, harassing or profane; (ii) restrict or inhibit any other user from using or enjoying the Site; (iii) constitute or encourage conduct that would constitute a criminal offense or give rise to civil liability; or (iv) contain a virus or other harmful component or false or misleading indications or origin or statements of fact.

Confidentiality

We make every effort to uphold confidentiality in all communication shared with us regarding your business and brand. We will only communicate about the design project with the persons identified on the by you as responsible for the Graphic Design project, and will not share it with anyone outside of PrintGiant, subject to our Privacy Policy and Terms & Conditions.

Project Hold/Cancel/Fees

You may put your project on hold once, at any time for up to 10 business days. If you do not reengage a project within 10 business days of placing it on hold, we may at our option cancel the project.

You may cancel your project at any time.

If you decide to cancel a project (which would include putting a project on hold and not reengaging within 10 business days, or becoming unresponsive at any point during the process), you will be charged a cancellation fee.

We will retain the following cancellation fee if a Graphic Design project is cancelled:

  • after project has gone into production - 25% of the design cost.
  • after submission of the initial design - 75% of the design cost.
  • after your initial response with revisions - 100% of the design cost.

What is included

When you are purchasing Graphic Design service from this Site, you are purchasing a limited service package.

Each Graphic Design project includes:

  • One (1) initial design.
  • Up to three (3) rounds of revisions.

Proofing

It is YOUR RESPONSIBILITY to check proofs carefully for accuracy in all aspects, ranging from spelling to technical illustrations. Once you approve your proofs, you are agreeing that you are fully satisfied with the document layout and content and you accept responsibility for any error there. PrintGiant will assume that you have verified the spelling, grammar, content, and layout, etc. are all correct and we will not accept any liability for errors such as misspelling, graphics, grammar, damaged fonts, punctuation, transparency, overprint, improper layout, bleeding, erroneous cut or fold lines, die lines, crop marks, sizing, etc. WE ARE NOT RESPONSIBLE for any misspellings, punctuation errors, grammar, wrong numbers, or any other content and/or data contained in a Graphic Design Project.

All proofs must be reviewed and all comments, revisions, corrections, and/or feedback must be made using the proofing system or software we provide. We will not accept comments, revisions, corrections, and/or feedback over the phone, email, text, IM, in person, through the mail, or any other method. In the case we do accept a comment, revision, correction, and/or feedback through another method that is not our proofing system, you assume any and all responsibility for any errors or omissions that may occur.

We reserve the right at our sole discretion to choose or develop the proofing system or service to use for proofing Graphic Design projects. Whatever the current proofing software or system we provide for you to use for proofing your Graphic Design projects, is provided “AS IS” “AS AVAILABLE” basis without warranties of any kind, either express or implied. PrintGiant does not represent or warrant that the proofing software or system offered will be accurate, complete, reliable, current, or error-free, that the proofing software or system offered will meet the user’s requirements, or that the proofing software or system will be provided in a timely, uninterrupted or secure manner.

A revision round is initiated when we upload a completed Graphic Design work into the proofing system, and a proofing system generated email is sent to you. A proofing round closed after any comments, revisions, corrections, and/or feedback is entered into the proofing system or service and a decision is made either by clicking the “Approve” or “Reject” button in the proofing system. A proofing round will remain open and revisions, updates, and/or changes will not be made or initiated to the artwork until either the “Approve” or “Reject” button has been clicked.

Finished Files

When a project is approved, we will provide you with files of your finished Graphic Design project. The number of files and file types provided will depend on the Graphic Design project type.

UNLESS OTHERWISE EXPRESSLY NOTED, OUR LAYERED “WORKING FILES” WILL NOT BE GIVEN TO YOU AND REMAIN THE PROPERTY OF PRINTGIANT.

The Finished Files for a Graphic Design projects intended for print will have the following properties

  • flattened vector PDF
  • CMYK color format
  • 300 dpi resolution
  • 1/8” bleeds (1/4” for booklets)
  • include any other mask layers required to provide the accurate finished result

The Finished Files for a Graphic Design project intended for digital use will have the following properties

  • flattened JPG and/or PNG
  • RGB color format
  • 96 dpi resolution

The Finished Files for a Logo Design project will have the following properties

  • vector EPS
  • vector PDF
  • JPG at 300dpi resolution
  • PNG at 96dpi resolution
  • style guide PDF

Rights to Work

PrintGiant is NOT an aggregator and/or platform that connects freelance designers with clients. We are an agency and the creative work is performed by our employees and or agents.

All intellectual property rights to designs and art work incorporated into the final Finished Files, including but not limited to photography and illustrations created by us or licensed by us on your behalf, will remain with us. You own text content, photographs and other data you provide, unless someone else owns them. We own all design code and native files and other design files used to produce the final Finished File and we license to you the Finished File for use in its intended purpose. You have unlimited license to use the final product that we create for you for its intended purpose.

Right to Display

Featuring and displaying our Graphic Design work is something that helps us show the value and quality of our Graphic Design service. You agree that we reserve the right to display your completed project and identify you as a user of our Graphic Design services and refer to you by name, trade name and trademark, if applicable, as well as display the completed works as part of our portfolio, on social media, or any other purpose for promoting our Graphic Design service. You may terminate this privilege at any time by sending us a notice to support@printgiant.com

Disagreement

It is our expectation that our customer service will be able to expeditiously handle any issues in a manner that you find satisfactory. If we are unable to settle any disagreement, we agree to try any issues exclusively in courts located in the State of Colorado using Colorado law.
